Fractional Chief Human Resources Officer (fCHRO) – Utah
5FT View Consulting is conducting a confidential search on behalf of a client, a privately held small business in Utah with approximately 12 employees, for a Fractional Chief Human Resources Officer to lead a focused 90-day HR audit and compliance build out. Following the initial engagement, the role transitions to an ongoing advisory capacity of approximately 3-5 hours per month to maintain compliance and support the company's people function as it grows.
Responsibilities:

 

Phase 1: 90-Day HR Audit and Compliance Setup

Foundational documentation: Develop the employee handbook and core HR policies, and establish organized, compliant personnel files for all employees.
I-9 and hiring compliance: Conduct a full I-9 audit and remediation, and review onboarding practices for federal and Utah state compliance.
Classification review: Audit FLSA exempt and non-exempt classifications, evaluate independent contractor arrangements, and confirm job descriptions reflect actual duties.
Wage and hour compliance: Review overtime calculation, meal and rest break practices, pay stub content, and Utah final pay timing requirements.
Statutory and posting compliance: Confirm workers’ compensation coverage, UI and DWS registration, new hire reporting, and required federal and Utah labor law postings.
Applicability assessment: Determine which federal and Utah employment laws currently apply at the company’s headcount, and right size policy accordingly.
Agreements and contracts: Review offer letters, employment agreements, and any restrictive covenants for compliance with Utah’s Post Employment Restrictions Act.
Reporting and roadmap: Deliver a written audit report with findings, risk ratings, and a prioritized remediation plan, along with an executive summary for ownership.

Phase 2: Ongoing Advisory (3-5 hours per month)

HR infrastructure maintenance: Keep policies, handbook, and personnel files current as regulations and the business evolve.
People operations support: Provide guidance on hiring, onboarding, performance management, and offboarding as needs arise.
Risk management: Serve as a point of contact for employee relations questions, complaints, and disciplinary or termination decisions.
Strategic HR guidance: Advise ownership on compensation structure, org design, and HR practices that support planned growth.

Qualifications:

 

  • HR leadership experience: 8 or more years of progressive HR experience, including prior CHRO, VP of HR, or senior HR generalist leadership roles.
  • Compliance expertise: Demonstrated experience with I-9 audits, FLSA classification, wage and hour compliance, and multi state or Utah specific employment law.
  • Small business fluency: Comfortable operating without a large HR infrastructure or team, and building compliant HR functions from the ground up.
  • Credentials: SPHR, SHRM-SCP, or equivalent HR certification strongly preferred.
  • Communication: Strong written and verbal communication skills, with the ability to translate compliance requirements into plain language for ownership.
  • Discretion: Comfortable handling confidential employee and business information with sound judgment.
Compensation & Logistics:
  • Rate: To be determined, commensurate with experience and qualifications.
  • Engagement structure: Phase 1 is a fixed scope 90-day HR audit and compliance build out. Phase 2 is an ongoing fractional advisory engagement of approximately 3-5 hours per month.
  • Employment type: Fractional, part-time.
  • Work arrangement: Hybrid, with periodic on-site presence in Utah as needed and remote work otherwise.
  • Reporting structure: Reports directly to ownership.
  • Start date: Immediate.
